These Terms and Conditions apply to purchases made through the Kinder Rave online store.

Mother Firm Buccelli / da Motta GbR, trading as Kinder Rave, is referred to in these Terms as “Kinder Rave”, “we”, “us” or “our”.

1. Scope
These Terms and Conditions apply to all orders placed through the Kinder Rave online store.
Our online store is intended primarily for consumers. A consumer is any natural person who enters into a transaction for purposes that are predominantly outside their trade, business or profession.
2. Products and Orders
The presentation of products in our online store does not constitute a legally binding offer. By submitting an order through the checkout, you make a binding offer to purchase the products in your order.
After placing an order, you will receive an electronic confirmation that we have received it. A purchase contract is concluded when we accept your order by confirming the order or dispatching the products.
We reserve the right not to accept an order where there is a legitimate reason to do so, for example if a product is unavailable, payment cannot be authorised, there is an obvious error in the product information or price, or we reasonably suspect fraud or misuse.
If we cannot accept an order after payment has already been made, we will refund the amount paid for the affected order.
3. Prices and Payment
All prices shown to consumers include applicable VAT unless expressly stated otherwise.
Any additional shipping costs will be displayed during checkout before you place your order.
For deliveries outside the European Union, customs duties, import taxes or other charges may be imposed by the destination country. Unless expressly stated otherwise, these charges are not included in the purchase price and are the responsibility of the recipient.
The payment methods currently available are displayed during checkout. Payment processing may be carried out by third-party payment providers.
4. Delivery
We deliver to the countries and regions available for selection during checkout.
Available shipping methods, shipping costs and estimated delivery times are displayed in the store or during checkout.
Unless expressly agreed otherwise, stated delivery times are estimates. If a delivery is materially delayed, your statutory rights remain unaffected.
For purchases made by consumers, the risk of accidental loss of or damage to the goods passes to you when you, or a third party designated by you other than the carrier, receives the goods, subject to applicable law.
Some Kinder Rave products may be produced, fulfilled or shipped on our behalf by third-party production and fulfilment partners. Kinder Rave remains your contractual seller regardless of which fulfilment partner produces or dispatches your order.
5. Cancellations and Returns
Consumers may have a statutory right to cancel an online purchase within 14 days without giving a reason.

Any additional voluntary return rights offered by Kinder Rave will also be described in our Refund Policy.
Your statutory rights in relation to defective, damaged or incorrectly supplied goods are unaffected.
6. Product Information
We make reasonable efforts to ensure that product descriptions, photographs, measurements and other information displayed in our store are accurate.
Colours and appearance may vary slightly depending on your device and screen settings.
For products manufactured or fulfilled by third-party production partners, minor variations that are customary for the relevant production or printing process may occur. Such minor variations do not constitute a defect where they do not materially affect the agreed characteristics or usability of the product.
Nothing in this section limits your statutory rights if a product is defective or does not conform to the contract.
7. Statutory Warranty Rights
The statutory warranty rights under applicable German law apply.
If an item you receive is defective, damaged or does not correspond to your order, please contact us at hello@kinder-rave.org.
Any manufacturer's or other voluntary guarantee offered for a particular product is additional to, and does not limit, your statutory rights.
8. Intellectual Property
Unless otherwise stated, the content of the Kinder Rave website, including the Kinder Rave name, logos, photographs, illustrations, graphics, text, video, audio and designs, is owned by or licensed to Kinder Rave and is protected by applicable intellectual property laws.
Content from the website may be used for personal, non-commercial purposes. It may not be reproduced, distributed, modified or commercially exploited without our permission unless such use is permitted by applicable law.
9. Liability
Kinder Rave is liable without limitation for damage caused intentionally or through gross negligence and for injury to life, body or health caused intentionally or negligently.
Kinder Rave is also liable without limitation where liability is mandatory under applicable law, including under applicable product liability legislation.
In cases of slight negligence involving the breach of an essential contractual obligation, our liability is limited to foreseeable damage typical for the type of contract concerned. Essential contractual obligations are obligations whose fulfilment is necessary for proper performance of the contract and on whose fulfilment the customer may normally rely.
Otherwise, liability for damage caused by slight negligence is excluded to the extent permitted by law.
These limitations also apply, where legally permissible, to our legal representatives, employees and agents.
Nothing in these Terms limits any statutory consumer rights or liability that cannot legally be excluded or limited.
10. Shopify and Third-Party Services
Our online store is powered by Shopify.
Products purchased through the Kinder Rave online store are sold by Mother Firm Buccelli / da Motta GbR, not by Shopify.
We may use third-party providers for services such as payment processing, production, fulfilment and delivery. The use of these providers does not affect your statutory rights against us as the seller.

11. Governing Law
These Terms and contracts concluded through the Kinder Rave online store are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer habitually resident in another country, this choice of law does not deprive you of mandatory consumer protections that apply under the law of your country of habitual residence.
